1. Parties

1.1. The operator of the website www.nouredesign.com (to be updated) (hereinafter referred to as “NOURE”).

1.2. The internet user who registers as a member of the website www.nouredesign.com (hereinafter referred to as the “Member”).

2. Subject of the Agreement

The subject of this Agreement is to determine the terms and conditions under which the Member may benefit from the website www.nouredesign.com owned by NOURE.

3. Rights and Obligations of the Parties

3.1. The Member declares and undertakes that the personal and other information provided while registering on www.nouredesign.com is accurate under the law, and agrees to indemnify NOURE immediately and in full for any damages arising from the inaccuracy of such information.

3.2. The Member may not share the password assigned by NOURE with any third parties or organizations. The right to use this password belongs solely to the Member. The Member shall be solely liable for all consequences of misuse. NOURE reserves the right to claim damages and assert all legal rights against unauthorized use.

3.3. The Member agrees to comply with all applicable laws while using www.nouredesign.com and undertakes not to violate them. Otherwise, all legal and criminal liabilities shall rest solely with the Member.

3.4. The Member may not use www.nouredesign.com in any way that disrupts public order, violates general morality, harasses or offends others, serves unlawful purposes, or infringes upon others’ intellectual property rights. Furthermore, the Member may not engage in activities that prevent or complicate the use of services by others (such as spam, viruses, trojans, etc.).

3.5. Opinions and ideas expressed, written, or used by Members on www.nouredesign.com are solely the personal views of the Members. These views are not related to NOURE. NOURE shall not be held liable for damages incurred by Members due to third-party statements or for damages incurred by third parties due to statements made by Members.

3.6. NOURE shall not be responsible for unauthorized access to Member data or for damages that may occur to Member software or data. The Member accepts in advance that they shall not claim compensation from NOURE for any damages resulting from the use of www.nouredesign.com.

3.7. The Member agrees not to access or use other internet users’ software or data without authorization. Otherwise, all legal and criminal responsibilities shall belong entirely to the Member.

3.8. A Member who violates one or more of the terms listed in this Agreement shall be personally liable both legally and criminally, and shall indemnify NOURE from any legal or criminal consequences. NOURE reserves the right to claim compensation for breach of contract.

3.9. NOURE has the unilateral right to delete a Member’s account and files, documents, and information associated with it at any time. The Member accepts this in advance, and NOURE shall not be held liable.

3.10. The software and design of www.nouredesign.com are the property of NOURE and are protected under copyright and intellectual property laws. They may not be used, acquired, or modified without authorization. Other companies and product names mentioned on the website are trademarks of their respective owners and are also protected.

3.11. For the purposes of improving and developing the website and in accordance with legal requirements, NOURE may collect information such as the name of the internet service provider used to access the website, IP address, access date and time, pages visited, and the web address of the site used to connect directly.

3.12. NOURE may use Members’ personal information to provide better service, improve products and services, and customize the website to user preferences. NOURE reserves the right to keep records of Member activities on the website.

3.13. By registering, the Member accepts that NOURE and its affiliates may send product/service promotions, advertisements, campaigns, surveys, and other customer satisfaction communications. The Member agrees to the collection, use, sharing, and storage of their personal and transactional data for these purposes, and authorizes NOURE and its affiliates to contact them via internet, phone, SMS, etc., unless the Member opts out.

3.14. NOURE may disclose Member personal information when required by law, or when deemed necessary in good faith to (a) comply with legal requirements or legal processes served to NOURE, or (b) protect and defend the rights and property of NOURE and its affiliated websites.

3.15. NOURE has taken measures to keep its website free from viruses and similar malicious software. However, ultimate security is the responsibility of the Member, who must obtain their own antivirus protection. By accessing the website, the Member accepts responsibility for all errors and consequences affecting their own software and operating system.

3.16. NOURE reserves the right to change website content, discontinue any services, or delete registered user information and data at any time.

3.17. NOURE may change, update, or cancel the terms of this Agreement at any time without prior notice. Updated or repealed provisions shall be binding upon all Members as of the publication date.

3.18. The Parties agree that all computer records belonging to NOURE shall constitute exclusive evidence in accordance with Article 287 of the Code of Civil Procedure and that these records form a contractual evidence agreement.

3.19. NOURE reserves the right to send informational emails to Members’ registered email addresses and SMS messages to their registered phone numbers. By accepting this Agreement, the Member agrees to receive such communications. Members may opt out of these services under “My Account” → “Membership Information.”

4. Termination

This Agreement shall remain in effect until the Member terminates their membership or NOURE cancels the membership. NOURE may unilaterally terminate the Agreement in the event of any breach of its provisions by the Member.

5. Governing Law and Jurisdiction

In case of disputes arising from this Agreement, Istanbul Courts and Enforcement Offices shall have jurisdiction.

6. Enforcement

By registering as a Member, the Member acknowledges that they have read and accepted all terms of this Agreement. This Agreement shall enter into force at the time of registration and shall be binding on both Parties.
